Avalanche hits hamlet in Himachal, 35 yaks killed in Sangla Valley

SHIMLA: An avalanche hit Himachal Pradesh's remote hamlet in the picturseque Sangla Valley on Tuesday, killing more than 35 domesticated yaks.

However, no loss of any human life was reported, deputy commissioner J.M. Pathania told IANS.

Rescue workers have been sent to the spot.

Sangla Valley in Kinnaur district experienced heavy snowfall last week, measuring more than six feet.

The entire Kinnaur district has been cut off from rest of the state and there has been absolute electricity failure since January 17.

Pathania said roads between the state capital and Rekong Peo, the district headquarters, are likely to be re-opened to traffic in a day or two.

JBT scam: Sentencing 'whistleblower' troubled me, judge says

NEW DELHI: Sentencing of IAS officer Sanjiv Kumar, jailed today for ten years in the teachers' recruitment scam, "troubled me" as it may send a wrong message that a whistle-blower is not appreciated by law, a Delhi court judge observed today.

Kumar was the erstwhile director of Primary Education in Haryana, who initially exposed the scam with a plea in the Supreme Court but was also found to be involved in it during the CBI probe.

Kumar along with former Haryana chief minister O P Chautala, his son Ajay Chautala and 52 others have been sentenced to varying jail terms for illegally recruiting 3206 junior basic teachers (JBT) in Haryana in 2000.

Special CBI Judge Vinod Kumar while sentencing Kumar observed that had he spoken the truth, at least at the stage of final arguments and the court would have treated him differently than the other convicts who were overseeing the execution of the entire conspiracy.

"What troubled me was to decide the question of sentencing Sanjiv Kumar. I have held him to be a 'whistle blower'. There is no law at present to protect the whistle blowers. Had Sanjiv Kumar not taken the step to approach the Supreme Court and had he not produced the second set of award lists, this scam would not have come to light," the court said in its 34-page order.

"The dilemma before this court in deciding the question of sentence is on account of simple reason that sentencing such a person may send a wrong message that a whistle blower is not appreciated by law, rather, he is put to trial and tribulation," the court said while suggesting principles to govern law for protection of whistleblowers.

"Law welcomes whistle blowers. If the whistle blower is innocent but only was a victim of circumstances, he must be cited as prosecution witness.

"If the whistle blower had a minor role in the commission of the offence or in the conspiracy for the commission of such offences, the courts should come forward to his rescue and in appropriate cases should not hesitate to make him an 'approver'," it said.

Ten people wanted in blast cases had links with RSS: Home secretary

NEW DELHI: At least 10 people, who were allegedly involved in a spate of terror attacks in different parts of the country, had links with RSS or its affiliated organisations, Union home secretary R K Singh said today.

"Yes, during investigation of Samjhauta Express, Mecca Masjid and (Ajmer) Dargah Sharif blasts, we have found at least 10 names who have been associated with the RSS at some point or the other," he told reporters.

Singh was replying to a question on whether government has any evidence linking RSS with any person involved in any terrorist strike anywhere in the country as claimed by home minister Sushilkumar Shinde.

"We have evidence against them. There are statements of witnesses," he said. The home secretary also made public the names of the ten persons who were allegedly involved in terror attacks and also had links with RSS.

The names given out by Singh included that of Sunil Joshi (dead), who was allegedly involved in Samjhauta Express and Ajmer Sharif Dargah blasts. He was an "activist of RSS" in Dewas and Mhow from 1990s to 2003.

Sandeep Dange (absconding), who was allegedly involved in Samjhauta Express and Mecca Masjid and Ajmer Sharif Dargah explosions. He was "RSS pracharak" in Mhow, Indore, Uttarkashi and Sajhapur from 1990s to 2006.

Akhilesh Yadav pulls up partymen for 'misuse' of party flags

LUCKNOW: Giving a strict message to partymen to be disciplined, Uttar Pradesh chief minister Akhilesh Yadav today said that he was getting complaints from various quarters regarding "misuse" of party flags that are being used in cars and the practise should immediately be checked.

"I am getting complaints from various quarters that party flags are being misused. The practise should be checked immediately...", Yadav said while addressing a gathering on the occasion of third death anniversary of party leader Jyaneshwar Mishra here.

About Mishra, Singh said that the scheme launched in his name would change the face of 1,000 villages in the state besides developing a park in the state capital.

"Some people wanted to claim on the park to be named after Jyaneshwar Mishra but we have give proof in the court regarding this...This park would be a big one and a tribute to the SP leader", he said.

Regarding party's 2014 preparations, Yadav said that partymen would have to gear up, otherwise they would lag behind others.

SP supremo Mulayam Singh Yadav in his address attributed son Akhilesh's entry into the politics to Mishra and said, "it was Mishra, who proposed Akhilesh's name from Kannauj seat, which was vacated by me after winning from Sambhal too".

Yadav said that it was the dream of Mishra to see party performing decisive role at the Centre and partymen should try to fulfil his dream.

Yashwant Sinha may contest Gadkari's re-election as BJP chief

NEW DELHI: BJP leader and former finance minister Yashwant Sinha may contest against Nitin Gadkari, who is seeking a second term as BJP president, party sources said on Tuesday.

Sinha had targeted Gadkari last year after corruption charges surfaced against the latter's company, Purti Group, and suggested he should step down as the party president.

"He (Sinha) collected a nomination form and a copy of the voters' list," BJP general secretary and election in charge Thawarchand Gehlot told reporters.

Nominations for the BJP president's post will be filed Jan 23 and a date for the poll would be announced if there is a contest.

In case there are no other nominations, Gadkari would be declared elected for a second consecutive term of three years.

Another Gadkari-baiter and former member of the BJP's national executive, lawyer Mahesh Jethmalani also indicated he would contest against Gadkari if no one else does.

BJP sources said Mahesh Jethmalani could face a technical problem as he does not fulfil the mandatory rule of being a member of the party for 15 years to be able to contest for the president's post.

Mahesh Jethmalani's father Ram Jethmalani, who was law minister in the BJP-led NDA government and represents the party in the Rajya Sabha, was suspended from the party for demanding Gadkari's removal over corruption charges.

Telangana movement to turn militant: Agitators

HYDERABAD: Telangana movement would turn militant in case the Centre fails to announce the bifurcation of state on January 28, warned the activists fighting for a separate Telangana state, on Monday.

In a round table meeting convened by the pro-Telangana New Democracy Party, the stakeholders of the movement resolved to launch the militant agitation aiming at stalling the functioning of the government machinery.

Representatives of Telangana Political Joint Action Committee (T-JAC), Telangana NagaraSamithi headed by an independent legislator NagamJanardana Reddy, and the political parties including TelanganaRashtraSamithi (TRS), BJP, and CPI took part in the round table meeting.

"We have decided to turn the Telangana movement into militant after January 28, if the decision of formation of Telangana not forthcoming on the day. There would not be scope for further talks and deliberations with the government and the policy makers. And it would be just a decisive battle," T-JAC chairman M Kodandaram told TOI.

While he declined to divulge the mode of agitation, he sought to clarify that it would not be an armed struggle.

"A Gandhian way of agitation is also militant when it comes to non-cooperation with the establishment. In that sense ours will be a militant agitation, but it will be more aggressive," added Kodandaram.

He said the government, the Congress, and the anti-Telangana forces including Seemandhra money bags and industrialists would be the main target.

Sources took part in the round table meeting said, the meeting decided to device strategies to block the government completely from functioning in its normal course. There would be agitation programmes including laying siege to the secretariat, government offices and establishments, and the residences of the members of the ruling Congress party.

"We want to take the movement forward in an aggressively non-violent way. But, if some violence happened in the due course, we will not be responsible. Let the government take the blame," said a T-JAC leader, who attended the round table meeting.

The leaders said they would not settle anything less than the announcement of a separate Telangana state with Hyderabad its capital. They would not tolerate any time buying strategies such as announcement of the bureaucratic procedures even if it is towards the division of the state.

"We insist, on January 28, the union government must announce the formation Telangana state with Hyderabad as its capital, in clear terms. And it must be the final announcement without calling for any bureaucratic procedures. We want to earn the government to full this demand failing which it would see a different face of the agitation," said K Govardan, a state committee member of New Democracy Party, who chaired the round table meeting.

Kalyan Singh merges party with BJP, cannot join himself

LUCKNOW: Former Uttar Pradesh chief minister Kalyan Singh, who had walked out of BJP before the 2009 LokSabha polls, today merged his Jankranti Party (Rashtrawadi) with the saffron party.

However Singh, an independent MP from Etah constituency, could not join the party himself due to the electoral clause under anti-defection law that requires him to first resign from the membership of the House.

The merger was announced by Kalyan's son Rajvir in a rally attended by BJP's top-brass leaders including national president Nitin Gadkari, Rajnath Singh, Mukhtar Abbas Naqvi, Uma Bharti, Kalraj Mishra and Vinay Katiyar.

Later talking to reporters, Kalyan said he is not joining the party right now as it will require him to resign from Parliament, thus necessitating a by-election which is unnecessary as the general elections are due in 2014.

Kalyan lashed out at Union Home Minister Sushilkumar Shinde for his remarks on BJP and RSS during the Congress conclave in Jaipur, and sought an apology from both Prime Minister Manmohan Singh and Congress President Sonia Gandhi over the issue.

"Prime Minister Manmohan Singh and Congress President Sonia Gandhi should apologise to the Hindu society for the minister's statement," he said.

Hitting out at parties "engaged in Muslim appeasement" for electoral benefits, Kalyan said BJP is not against the Muslim community and all it wants is a policy of justice to all.

Upsurge after Delhi gang rape was necessary, says Chief Justice of India Altamas Kabir

NEW DELHI: Chief Justice of India Altamas Kabir on Monday said that the huge public outrage and the protests that followed the brutal gang-rape of the 23-year-old paramedical student in Delhi on December 16, 2012 were justified and necessary.

"I wish I could also have been there, but I can't" Chief Justice of India Altamas Kabir on Monday said while terming the upsurge and protest that took place in the wake of the December 16 gang-rape incident as "fully justified" and "absolutely necessary".

"What happened that day (December 16) was not something new ... but it caught the imagination of the people and led to a tremendous upsurge and this upsurge as I have said earlier also, was fully justified. What started as a protest, as a mark of showing one's anger, it was all genuine, absolutely necessary ...", Justice Kabir said.

"I salute everybody who took part (in the protests). I wish I could also have been there, but I can't," he said on the sidelines of the Sixth National Conference on the Protection of Women from Domestic Violence Act.

He, however, cautioned "that we cannot afford certain types and groups of people from exploiting such situation for their own ends".

"My nephew was also beaten up in the protest (at India Gate)," Justice Kabir said, adding "the protest was later on hijacked".

He said that it started out as a "peaceful protest", but other "things" started coming in and it "became ugly".

While addressing the gathering which comprised of sitting Delhi high court judge Justice Gita Mittal as well as several legal luminaries and academicians among others, Justice Kabir also said that what happened on December 16 was not just a crime against an individual, but against women and society in general.

Referring to the "shameful" incident of December 16, when a 23-year-old girl was brutually gang-raped in a moving bus and later thrown out of it along with her male friend, Justice Kabir said it has resulted in a tremendous rethinking of "what is going on" in the society.

The CJI also said there is a need to changing the mindset of the judicial officers who take up such cases.

"Many of us (judges) are quite insensitive. Many of us look to the strict letters of the law," he said, adding that he has reminded people, especially judicial officers, to be sensitive to problems related to women and children as they are the most vulnerable sections of society.

"Dont just think of letter of the law, but for God's sake also think of the spirit of law. I say take the spirit and the letter of the law, combine them together and you will have something worth looking forward to," Justice Kabir said.

On the topic of more fast track courts, the CJI said that the government will provide funds for the fast track courts.

He said that earlier, lack of funds had resulted in several states not continuing with fast track courts. Now, various states have come out saying they will fund these courts and will continue with them, he said.

He also lamented that had the apex court's directions to remove the curtains and black film been implemented then "no one would have dared to do such a thing in a moving bus".

Court to hear arguments in camera

Meanwhile, trial proceedings in the December 16 Delhi gang-rape case will be held in camera before a fast track court, which decided on Monday to hear arguments on framing of charges against five accused on January 24.

Upholding the previous order of a magistrate, the special fast track court judge said, "Only those who are connected with the case will stay in the courtroom. Others should vacate the court immediately."

Additional Sessions Judge Yogesh Khanna also decided to hear "in camera" the arguments on framing of charges against the five accused on January 24 as the judicial records were sent by the magisterial court after concluding the procedural formalities.

Invoking a legal provision that bars open court hearing, the special judge said, "As per section 327 (2) of the CrPC, the proceedings will be held in camera and section 327 (3) prohibits anyone from publishing and printing the proceedings."

"I am upholding the same order passed by the metropolitan magistrate (MM)."

Chief Justice of India Altamas Kabir had inaugurated the fast track court at Saket district courts complex earlier this month following a decision of the Delhi government in this regard.

Earlier, the MM had allowed an application of Delhi police seeking in camera proceedings following the chaos in the courtroom when the accused were being brought.

The accused have been charged under the IPC for offences of murder, gang rape and destruction of evidence.

The 23-year-old paramedical student was brutally assaulted and gangraped in a moving bus allegedly by six persons, including a juvenile, on the night of December 16 before being dumped in a south Delhi locality here. Her male friend was also assaulted.

The victim later died at a Singapore hospital.

Earlier, special public prosecutor Dayan Krishnan and Delhi Police counsel Rajiv Mohan along with the investigating officer entered inside the packed courtroom where the proceedings were to commence before the special court at 2.30pm for the first time.

Besides 30-40 security personnel, defence lawyers and journalists were also inside the court room where all the accused were brought in with their faces muffled up.

The driver of the bus Ram Singh, his brother Mukesh, Akshay Thakur, Pawan Gupta and Vinay are the accused in the case. While their juvenile accomplice is being tried separately at the juvenile justice board here.

Except Thakur, who was arrested from Aurangabad in Bihar on December 22, rest four accused were arrested within 24 hours of the incident.

Special prosecutor Krishnan started the argument with a plea that the special court should give an order as to whether the trial proceedings would be open for all or it would be held in camera.

Citing legal provisions and the previous order of the magistrate, he said the section 327 (2) and (3) of the CrPC specifically provides that the trial in rape cases "shall be held" in camera.

He argued that even though the detailed proceedings in the case cannot be allowed to be reported as per the earlier order, but the special court needs to pass an order which should decide the issue whether it can be reported or not.

"in camera proceedings under section 327 (2) of the CrPC should go on. Reporting of proceedings by the media, under section 327 (3), is upto the court to decide," Krishnan said.

He also said that if the judge deems it fit then he can allow media to publish a brief of the proceedings or can pass an order regarding how much media can report or publish.

"But, detailed reporting of the proceedings may not be allowed," he added.

Defence lawyers VK Anand and RP Singh sought lifting of the ban on media saying that the denial may result in misreporting.

Swami Om Ji, a self-proclaimed spiritual guru who had earlier withdrawn his plea in the high court seeking a direction to allow media to cover the case, again appeared before the special judge on Monday raising the same issue.

However, the court dismissed his plea saying he does not have any locus.

Around 200-300 protesters had gathered outside the court complex for a brief period. Later, most of them left after security personnel denied them entry.

Dismissing a plea for the open court trial, the special judge, in his 5-page order, said, "All persons un-connected with the case are directed to clear the courtroom and to ensure safe passage to the accused person. It shall not be lawful for any person to publish or print any matter relating to the proceedings of this case except with the prior permission of the court, till the trial.

"Such an order is, even otherwise, necessary, considering the sensitivity of the matter, concealing the identity of victim, safety of the complainant, safety of the accused person to ensure the fair trial and also for smooth functioning of the court."

The special judge also said, "Sub section (2) and (3) of section 327 of CrPC are inserted by an Act 43 of 1983 ... hence, there is nothing much to say about the issue (of in camera proceedings) raised and I am in conformity with the metropolitan magistrate as also with the order dated January 9 passed by the judge in charge, south and southeast district ..."

Digvijaya's brother Laxman returned to Congress party on Monday

BHOPAL: Former Madhya Pradesh chief minister and AICC general secretary Digvijaya Singh's brother Laxman officially returned to the Congress party on Monday. The Madhya Pradesh Congress confirmed that his return to the party was cleared by the high-command after which elder brother Digvijaya proposed his membership which was accepted AICC general secretary in-charge of Madhya Pradesh BKHariprasad at 24 Akbar Road.

Digvijaya Singh supporters in the state Congress were jubilant after the return of Laxman Singh. PCC media cell chairman Manak Agarwal explained: Laxman Singh's return is a victory for the Congress. After Laxman Singh split from the Congress, he was the only leader the BJP had in Rajgarh district. Now they have none. Now, Rajgarh belongs to us.''

Soon after his official acceptance into the Congress, Laxman Singh said: I will work for the Congress with full dedication and with all my strength. There was a lot of pressure from Congress workers in my home district to join back the party and I decided it was time to return.'' Asked why he left the Congress in 2004 after Congress debacle in Madhya Pradesh, Laxman Singh said: There were some personal reasons for that decision. But I always respected the Gandhi family.''

Laxman Singh had left the Congress amidst high family drama. He walked into newly elected BJP chief minister Uma Bharati's office and claimed he wanted to join the BJP. Brother Digvijaya was heart-broken and sent several family members including his wife Asha to stop Laxman from joining the rival party. But Laxman not only joined the BJP but even won the Lok Sabha seat from Rajgarh constituency.

Speaking on what led to his expulsion from the BJP three years ago, Laxman Singh explained,"I was annoyed with the way BJP president Nitin Gadkari made a personal attack while addressing a public meeting. The president of a national political party should not give statements like the one he made.''

In July 2010, Laxman Singh was expelled from the primary membership of the BJP after he publicly condemned Nitin Gadkari for his public speech on the Congress party and Afzal Guru.
