The need for the family court in each district has emerged due to ever increasing number of cases arising due to marital disputes. If officials at law department are to be believed, the figure stands in lakhs and the pendency is increasing every day. "Every marital dispute case gives birth to several other cases between two families,'' said an official.
In this regard, the law department after creating the posts has sent a letter to the Allahabad high court informing them of the development. The constitution of 63 family courts will result in appointments of 504 employees on various positions.According to the government officials, the presiding officers in these family courts will be appointed by the Governor on the High Court's recommendation from the Higher Judicial Services (HJS) cadre. The 156 ex-cadre posts of the fast tract courts, which no more exist, will be absorbed by these courts. Each family court will be headed by an additional district and sessions judge, who will operate under the district judge.
To set up the family courts, the state government has sought financial assistance of the Central government. Officials said that it was in May 2008 that the registrar of the High Court had written to the state government, expressing the need to constitute family courts in every district. Another reminder was sent in May last year.
