The ship was intercepted by the Indian Coast Guard off the Kanyakumari coast on October 11 and was detained and brought to Tuticorin. The 'Q' branch CID, Tuticorin, registered a case against 35 sailors on the ship and launched a probe.
In his petition, V Anbalagan of Chennai contended that the Tamil Q branch police had failed to book the accused people under crucial laws, including the Suppression of Unlawful Acts against Safety of Maritime Navigation and the Fixed Platform On Continental Shelf Act, 2002.
He contented that the 'Q' branch police don't have sufficient facilities to continue with the probe. Further, out of 35 remanded people, 12 people are from Haryana and Maharashtra and the remaining are from foreign countries like Estonia, England and Ukraine and so it would be difficult for the 'Q' branch to continue with the probe. Hence, it is necessary to change the probe from the 'Q' branch to the CBI or the NIA, the petitioner argued.
A bench comprising Justice R Sudhakar and Justice S Vaidyanathan dismissed the petition when the government informed it that the investigation was going on and the concerned people had filed for bail.
