The first bench comprising Chief Justice RK Agrawal and Justice K Ravichandrabaabu, dismissed the PIL filed by advocate N Kanagasabai, after additional solicitor-general P Wilson filed documents to prove that the Centre had already relaxed the eligibility so as to cover everyone who had rendered exceptional performance in any field of human endeavour. Further details of the order, however, were not immediately available.
In his petition, Kanagasabai said Bharat Ratna, instituted in 1954, could be conferred on eminent people for their contribution to arts, literature and science alone. Without amending the Presidential notification including other fields in the eligibility list, sportspersons such as Sachin Tendulkar cannot be chosen for the highest civilian award. The announcement of the award to Sachin Tendulkar and scientist CNR Rao was not preceded by the mandatory gazette notification, he said.
Countering the submissions, Wilson filed a memo stating that the PIL had been filed on wrong premises that Bharat Ratna can be awarded candidates from arts, literature and science fields only. He said the PIL had not disclosed the fact that the presidential notification had been suitably amended on November 16, 2011 to include persons from any field for conferment of the honour.
The memo further said that the spirit of sportsmanship displayed by Sachin Tendulkar has been exemplary and his performance has been of the highest order in the field of sports.
It said the proposal to confer Bharat Ratna on Professor Rao and Sachin Tendulkar was sent by the Prime Minister to the President on November 15, and the latter conveyed his approval on November 16. A formal notification in this regard would be issued shortly by the President's secretariat, and the award would be conffered on the two by the prime minister at the formal investiture ceremony at the Rashtrapathi Bhavan.
