UPA hopeful of tabling Anti-Communal Violence Bill in winter session: Shinde

NEW DELHI: Not withstanding the stiff opposition of several states to the reworked Prevention of Communal Violence Bill, the UPA government has refused to give up hope of tabling it in the current session of the Parliament.

"The anti-communal violence bill was one of the actions promised by the UPA government. We will implement it," Shinde said adding that the government intends to bring it before Parliament in the current session itself.

"This Bill has been pending for a long time. Lot of discussion had been done and recently, the home secretary had invited the state home secretaries and discussed the draft Bill at length," the home minister told newspersons at a press conference here on Tuesday to present the MHA's report card for the month of November.

Many state home secretaries had raised objections to the "anti-federal" provisions of the Bill at the meeting with the home secretary last Tuesday. Not only this, the chief ministers of Tamil Nadu, Gujarat and Odisha wrote to the Prime Minister, opposing the move to bring a Bill against communal violence, which falls exclusively in the states' domain. The chief ministers questioned the timing of the Bill just ahead of Lok Sabha elections and dismissed the new draft as a "deliberate encroachment upon the jurisdiction of the states."

When asked if the consultations with the states were over, leaving the Union home ministry free to get the new draft Bill approved by the Cabinet, followed by its introduction in Parliament, Shinde said: "The states can still talk to me and communicate their reservations on any point in the Bill."

With just 10 days to go before the winter session winds up, there are serious doubts whether the government can get the anti-communal violence Bill through.

Incidentally, Shinde also said the government was hopeful of bringing the Jan Lokpal Bill in this session. "Our intentions are clear. The agitation for Jan Lokpal law has been going on and Anna Hazare is now again sitting on fast to demand its enactment. As promised, the Bill was passed by the Lok Sabha in December 2011, after which the Rajya Sabha referred it to the select committee. The panel suggested some changes. The Bill is now pending in the Rajya Sabha...the minister of state concerned has already given a notice to the Rajya Sabha chairman to take up the Bill immediately," he informed.

As for the Telangana Bill, Shinde said the President was yet to refer it to the Andhra Pradesh assembly for its comments. As per the procedure, he explained, the Bill had to be considered by the assembly, after which it would come back to the President. "The President would send the Bill and assembly's comments to the home ministry, which will then bring the fresh draft Bill before the Cabinet. Only after that can it be taken up by Parliament," he said, indicating that the Bill was unlikely to be taken up in the current session.
