AHMEDABAD: The Central Bureau of Investigation (CBI) on Wednesday raised a question on the inordinate stay of D G Vanzara, suspended DIG and an accused in fake encounter cases, in Sabarmati central jail. The CBI told a sessions court that only Vanzara and jail authorities would know why his custody had not been transferred to the jail in Maharashtra.
While opposing Vanzara's bail application in the 2004 Ishrat Jahan fake encounter case, the probe agency submitted to the court that the cop was brought from Taloja central jail to Ahmedabad for interrogation. After his remand was over in the second week of June 2013, the magisterial court sent him back to Sabarmati jail with instruction to send him back to Taloja jail, where he was in judicial custody in the 2005 Sohrabuddin Sheikh fake encounter case. Vanzara and other cops were shifted to Mumbai jail in November 2012 after the SC transferred the case.
The CBI said in its affidavit that despite standing order by Mumbai's special CBI judge S G Dige issued on May 30, 2013 and the Supreme Court's direction while transferring the trial outside Gujarat, "For the reasons best known to Vanzara and the jail authorities... Vanzara is still lodged at Sabarmati central jail, instead of undergoing judicial custody at Taloja central prison, Maharashtra".
Besides, the CBI urged the court not to grant bail to Vanzara on the grounds that there were instances in the past in the Sohrabuddin encounter case of attempts by the accused cops of influencing witnesses. And it was this factor that played a major role in the apex court's decision to transfer the case outside Gujarat for fair trial.
The agency cites the chargesheet that shows how Vanzara, along with other senior officers, was involved in the conspiracy of killing Ishrat and three others. Further hearing will take place later this month.
Vanzara is behind the bars for past seven years in the Sohrabuddin encounter case.
