Bombay HC asks PIL on fair elections to be treated as representation by EC

MUMBAI: The Bombay high court on Monday directed the Election Commission and law commission of India to consider a public interest litigation as a representation for amending the law to ensure that the forthcoming assembly elections are held in a free and fair manner.

A bench of chief justice Mohit Shah and justice M S Sonak was hearing a PIL filed by Sharmila Ghuge a law faculty at Jitendra Chauhan College of Law in Mumbai and Anand Sarda a social worker from Nagpur. Their lawyer Shyam, Dewani submitted that the election commission ought to extend the two child norm applied during panchayat elections as a prohibition to contest election to the upcoming assembly elections as well and device a system for even those people who cannot be present physically on the poll day to cast their votes.

The PIL made a slew of suggestions which it said the EC ought to consider to make sure that elections in a democracy which is vibrant stays free of lumpen elements. There must be a restriction in the number of candidates and prevent those having chargesheets against them from contesting to avoid burdening the state exchequer of having to conduct a by-election if the candidate wins and is later convicted. Ghughe said corporate firms or organizations facing prosecutions must not be allowed to make donations to any political party and all donations must be brought under the ambit of the Right to Information Act.

The Bench said given the paucity of time before the elections are held it may not be possible for the state election commission to consider and incorporate the suggestions given in the code of conduct for the upcoming elections. The HC however directed the petitioner to make law commission a party and direct the EC to consider the reforms as suggested in the PIL.
