Supreme Court on Friday ordered the release of prisoners who have spent half of the maximum sentence prescribed for the offences they are charged with.
"None of Chhattisgarh jails have undertrial who fall under this category. However, there are many undertrial of serious offences like murder who have been languishing in jails for long, but those with serious offences are not supposed to give relief as per apex court's order," Nayak told TOI.
He added that state courts have been regularly monitoring long pending cases of undertrials and conduct speedy trials on those cases on priority basis. "Jails are supposed to send details of undertrials languishing in jails for months and years, every month to court. And the disposal of such cases takes place accordingly."
Nayak said that as per reports of National Crime Records Bureau 2012 India has 63 percent undertrials and 37 percent convicts languishing in jails while Chhattisgarh has around 48 per cent of convicts and 52 per cent undertrials.
Incidentally, Chhattisgarh ranks among top states for overcrowded jails with more than 8930 inmates against capacity of 5850 as per NCRB 2012. Uttar Pradesh, Madhya Pradesh and Delhi are other states with exceptionally large number of overcrowded jails in country.
Presently, state's population of inmates is 16,462 with 6,740 convicts and 9,722 undertrials.
