Besides, the amendments also provide for allowing confiscation of property acquired by public servants through corrupt means and broadening the definition of 'bribery' covering act of foreign intermediaries or middlemen as an offence under the Prevention of Corruption Act.
At present, the government's protection -- which is available to only serving public servant in the form of prosecution sanction -- does not extend to 'babus' once they retire. Government has felt the need to bring the amendment to extend this protection to the retired ones so that it would be mandatory for the prosecuting agency to get prior sanction before going in to prosecute them for something which they might have done with good intention.
The proponents of the amendment, giving protection to retired public servants, believe that there is a need to protect such officials as they had to sometimes take a decision in good faith keeping in mind the larger public interest.
"Public servants won't take any tough decision if you go on prosecuting them for any bona fide omission or commission in the discharge of their official duties", said an official.
Other amendment relates to confiscation of properties of corrupt public servants. If accepted by the Cabinet, the change will empower special judge to exercise powers of attachment of properties before judgment in the corruption case.
