SHIMLA: Himachal Pradesh government has requested the union government to relax the condition of applicability of Environment Impact Assessment (EIA) clearance for two years or till the same is issued by the competent authority whichever is earlier to meet out the demand of mineral through legal source.
Industries minister Mukesh Agnihotri informed this in a written reply to the question of Congress MLA from Dalhousie Asha Kumari. Minister informed in his written reply that Supreme Court of India in its February 27, 2012 order has directed that leases of minor minerals including their renewals for the area less than five hectares be granted by the State/Union Territories only after getting environment clearance from Ministry of Environment & Forests (MOEF), Government of India.
He said that accordingly the MOEF issued notification on September 9, 2013 making environment clearance mandatory for leases of minor minerals for areas less than 50 hectares also. Subsequently, the National Green Tribunal on August 5, 2013 has restrained mining activities over riverbeds throughout the country without environmental clearance, due to which the state government had to suspend the mining leases sanctioned on river beds.
He said that to control illegal mining in the state, government has made penalty provisions more stringent and compounding rates of illegal mining/ transportation of mineral has been enhanced. Earlier, there was a provision of imprisonment of one year and fine of Rs 5000 in case of illegal mining which has now been enhanced with two years imprisonment and fine upto Rs 25000 and minimum compounding fee of offence will not be less than Rs 10,000.
He said that penalty provision for illegal transportation of mineral has also been enhanced. Earlier, there was a provision of imprisonment of one year and fine of Rs 1000 which has now been enhanced with imprisonment of two years and fine upto Rs 25000.
He said that state government has taken up the matter with the National Green Tribunal for vacation of stay granted on August 5, 2013 through Additional Advocate General at New Delhi.
