Mishra was, however, shifted to the Rajendra Institute of Medical Sciences (RIMS) for better medical care as he has been suffering with multiple ailments. The direction for proper treatment and medical care was given to the jail authorities by the court in its order.
Mishra has been out on provisional bail within three weeks of conviction in October 2013, in the RC20A/96 case of fodder scam which is considered mother of all fodder scam related conspiracy cases. Having filed an appeal in the high court against the conviction by special CBI court, Mishra's counsel had applied for confirmation of the bail on merit hearing which court of justice DN Upadhyay had directed Mishra to surrender before the subordinate court first following which the process of hearing on confirmation of bail is to start.
Mishra's counsel Rakesh Jha said that while hearing the petition for confirmation of bail, high court on December 18, 2014 extended the provisional bail till March 19, 2015 and directed Mishra to surrender by March 20. "Due to certain technical reasons the order of the high court was modified and my client was directed to surrender before the court on or before March 19 and the matter is listed for hearing in the high court for Friday," he said.
Jha said that Mishra has been convicted in only one case as all other cases of fodder scam pending against him were quashed by the high court. "We have appealed against the judgement of CBI court in RC20A/96 before the high court but it has not yet come up for hearing and in the meanwhile request for confirmation of the bail has been prayed," he said.
Mishra who suffered a brain stroke few months before being convicted in October 2013 is learnt to have been suffering with type II diabetes, cardiac problem, and urinary tract infection and recently has been diagnosed with blood cancer. Jha said that his client is undergoing treatment at Medanta and is also under supervision of medical experts of AIIMS.
