CBI opposes Rajiv killer Perarivalan's plea

CHENNAI: Three weeks after death convict in Rajiv Gandhi assassination case, A G Perarivalan sought to virtually reopen the assassination case by requesting the designated TADA court to order and monitor further probe, the CBI has said such a move would be contempt of the Supreme Court.

Dismissing Perarivalan's allegations such as a claim that several important files were either stolen from or destroyed at the prime minister's office and that the CBI's MDMA had not properly probed several leads suggesting international conspiracy to the assassination, the CBI said they were baseless and devoid of merit.

In a counter-affidavit filed in the court of V additional sessions judge N Dhandapani, who held the additional charge of the designated court on Thursday, CBI special public prosecutor N Ranganathan said entertaining the petition would amount to commenting on the findings of the apex court in the case. "It smacks of contempt of court," he cautioned, adding that the case had been investigated, tried, adjudicated and even the appeals had been decided by the Supreme Court.

Noting that the Multi-Disciplinary Monitoring Authority (MDMA) was constituted by the CBI on December 2, 1998 as per the Jain Commission of Inquiry recommendations, the counter-affidavit said its functions included monitoring and investigating various issues arising out of reports before the commission. The MDMA was monitoring the movements of all the absconding accused and was trying to bring them to trial, it said.

In his petition, Perarivalan said the MDMA had turned a blind eye to several key facts, including intercepted messages from foreign countries. Though the MDMA was constituted to investigate the larger conspiracy aspect of the assassination and it was mandated to monitor movements of the absconding accused and bring them to trial, nothing much has been done by the agency, he said. The agency has also failed to probe the activities and complicity of several well-known people and their role in the offence, he said.
